Terms of Service

1. The agreement

These terms are an agreement between you and Mykola Breslavskyi, Poland ("Tracebrain", "we"). By creating an account or using Tracebrain you accept them, together with the Privacy Policy. If you do not accept them, do not use Tracebrain.

2. Early access

Tracebrain is pre-release software offered to an early-access group. Features will change, things will sometimes break, and the service may be interrupted or withdrawn.

Tracebrain is not a backup of your conversations. The originals stay in your messaging apps; keep them there. Do not rely on Tracebrain as the only copy of anything you cannot afford to lose.

3. Who can use it, and your account

4. Connecting your channels

5. Your content

Your conversations, and the notes Tracebrain writes from them, are yours. You give us permission to store, process and display them only to provide Tracebrain to you, which includes sending them to the providers named in the Privacy Policy. We claim no ownership of your content, we do not sell it, and we do not train AI models of our own on it. The permission ends when the content is deleted.

6. Other people's information

Your conversations contain the words and details of other people. You are responsible for having the right to keep and process them with Tracebrain, and for following the laws and duties that apply to you — privacy law, confidentiality, professional secrecy, your employer's rules.

7. Acceptable use

Do not use Tracebrain to:

8. Notes written by AI

Profiles, daily notes and tasks are generated automatically. They can be wrong, incomplete, or missing the context that mattered: a profile may state something the person never said; a promise may be missed. Check the conversation before you rely on a note. Nothing Tracebrain writes is legal, medical, financial or other professional advice, and what you do with it is your responsibility.

9. Price

Tracebrain has one paid plan, at the price shown on the pricing page before you pay. It starts with a seven-day trial: you give a card, nothing is charged until the trial ends, and cancelling before it does costs you nothing. Nothing is charged unless you complete a checkout.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it takes the payment, charges any tax that applies, handles refunds and billing questions, and its buyer terms apply to the purchase.

The subscription renews every month until you cancel it. You can cancel at any time from the link in your Paddle receipt, from Manage subscription in the account menu, or by writing to [email protected]; the plan then runs to the end of the month you have paid for. A month already started is not refunded as a matter of course — the Refund and Cancellation Policy says the whole of it.

10. Changes and availability

We may add, change or remove features, and suspend the service for maintenance or security. We will try to give notice of changes that matter to you.

11. Ending this agreement

12. No warranty

To the extent the law allows, Tracebrain is provided "as is" and "as available", without warranties of any kind. We do not promise that it will be uninterrupted or free of errors, or that data will never be lost.

13. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits or lost data, or for anything a third-party platform does — including restricting your messaging account. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before it arose and EUR 100.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, intent or gross negligence, or takes away rights you have as a consumer.

14. If your use causes a claim

If someone brings a claim against us because you connected an account that was not yours, or used Tracebrain in breach of these terms, you will cover our reasonable costs, to the extent the law allows.

15. Governing law

These terms are governed by the laws of Poland, and its courts hear any dispute. If you are a consumer, you keep the mandatory protections of the country you live in, and you may bring proceedings there.

16. Changes to these terms

When these terms change, the date at the top changes with them. For changes that matter we will email you at least 14 days before they take effect. If you keep using Tracebrain after that, you accept the new terms; if you do not, stop using Tracebrain and ask us to delete your data.

17. General

These terms and the Privacy Policy are the whole agreement between us about Tracebrain. If a part of them cannot be enforced, the rest stays in force. If we do not enforce a term at once, we have not given it up. We may transfer this agreement to a successor that takes over Tracebrain; you may not transfer it.
